  競爭,為經濟市場運作之基石,要維持市場秩序的穩定,需有良好的競爭關係。表徵,因其具備識別商品或服務來源之功能,在競爭市場中占有至關重要的地位,且透過事業的長期投資與經營,隨著消費者對表徵產生顧客愛好而具有財產價值。賦予表徵法律上保護已為國際趨勢,惟各國法制背景及社會觀念發展各異而保護途徑不盡相同,有以不正競爭法保護者,亦有以商標法規範者,本文擬就表徵保護相關法制規範進行分析比較,期供我國立法修正時之參考。
英文摘要
Competition is the foundation of economic market; it requires a good competitive relationship to maintain the stability of market order. Trade dress acts a vital position in the competitive market as it identifies the source of goods or services and can thus create property value through a long term investment from the enterprise to establish the goodwill. Entitling legal protection to trade dress has become an international trend; it conducts by means either the unfair competition law or the trademark law. This article analyzed the regulation of trade dress between several countries and expects to become the references of legislation revise in the future.
