This article is based on the concept of orderly economic liberalism and discusses the importance of the free market in the EU's economic policy. It corresponds to our digital market competition policy, examines the scope of its constitutional interpretation, and points out the economic order guiding function of the constitutional amendment provisions.

 

< Smart Medical Device and the Physician’s Duty of Care: A Preliminary Study (1) > The authors are Doctor Huan-Wu Chen and Professor Hsiu-I Yang. This article is based on clinical experience, analyzing the key points and possible types of errors in the regulation of smart medical devices. It then explores the adjustment of physicians' responsibilities in using smart medical devices.

 

< Consumer Protection Mechanism for Third-Party Payment Services and Electronic Payment Institutions: A Discussion on the Feasibility of the Application of FTC Act > The author is Lawyer Chia-Yi Lin. The content of this article discusses the complexity of administrative control and dispute resolution mechanisms due to the differential regulation of third-party payments and electronic payments under our laws. It introduces the case of the U.S. legal system and the intervention of the Federal Trade Commission to explore the possibility of improving administrative control measures in our country under the existing laws.

 

< Judges’ Legal Instructions to Citizen Judges and Appellate Court Review Standards of Legal Instructions: From an American Perspective to Review the Taiwanese System > The author is Professor Tzu-Te Wen. The article reviews the inadequacies of the "legal description" system of the National Judges Act. It uses the U.S. legal system as a basis for comparison, examines the basis for superior scrutiny involved in erroneous jury instructions, and finally proposes the construction of future legislative theory.
