< Marry Out and Become an Outsider, Marry in and Become a Citizen : Marriage as a mediating mechanism of women’s indigenous status and nationality> The author is Professor Chao-Ju Chen. This article is to discuss two types of legal regulations of female identity in Taiwan history. One is the “Marriage Out” Clause for aboriginal women, and the other is “Marriage In” Clause for foreign women to acquire our nationality. The Observations and conclusions will be presented with the perspective of feminist legal theory and critical race theory.
< A Reflective Study on Offense of Participants’ Interference with Public Order > The author is Professor Heng-da Hsu. This article focuses on the changes after the law amendment in 2020, that the practical interpretations of Art.149 and Art.150 of the Criminal Law about the crime of offense of participants’ interference with public order. In addition, it analyzes the limits and doubts of the application of individual crimes from the perspective of the basic doctrine of Criminal Law.
< Discussing the Secrecy of Final Deliberation of the Lay Judge System in Taiwan from the Principle of Fair Trial> The author is Shou-Peng Huang. This article is to observe the upcoming lay judge system in Taiwan with the perspective of fair trial principle. In addition to pointing out the dilemma between the benefit of confidentiality in the deliberation process and the impartiality of court, it will also propose some suggestions about the law amendment.
