儘管迄今的文獻(Welzel, Vicen, Broeckman)都指出,「法之哲學」與「法哲學」的用語第一次出現於Gustav Hugo在1798年出版的《作為實證法之哲學的自然法教科書( Lehrbuch des Naturrechts als einer Philosophie des positiven Rechts)》,但這個用語與概念卻很早就出現了,特別是在17世紀的拉丁文術語「法之哲學(philoisophia juris)」。Gottfried Achenwall也大概在18世紀中葉使用了這個用語與概念。該概念的德文表述也早在18世紀末期先於Hugo且多次被使用,用來與自然法做出區別。本文旨在追溯這個用語與概念從17世紀到19世紀初期的歷史。
英文摘要
While the pervious references (Welzel, Vicen, Broeckman) locate the first mention of the term “Philosophy of Law” or rather “Legal Philosophy” in Gustav Hugos work “Lehrbuch des Naturrechts als einer Philosophie des positiven Rechts” in 1798, the term and the concept appeared very much earlier, especially as Latin terminus “philoisophia juris” in 17th Century. Gottfried Achenwall also used them in about the middle of 18th Century. The German version had already been used before Hugo in the end of 18th Century several times. This article traces the history of the term and the concept from the beginning in 17th to the 19th Century.
